Certified Legal Translation

US federal court proceedings are conducted in English. Any foreign-language document offered at trial or used as a deposition exhibit must be translated, and the translation must be authenticated. Federal Rule of Evidence 901 sets the general standard: the proponent must produce evidence sufficient to support a finding that the item is what the proponent claims it is.

For translated documents, the typical foundation is a sworn declaration or affidavit from the translator describing qualifications, language competence, and affirming accuracy of the translation. Some foreign public documents are addressed under Federal Rule of Evidence 902, which permits self-authentication for documents bearing a final certification of genuineness, with apostilles often satisfying this requirement for Hague Convention countries. Federal Rule of Civil Procedure 44 sets out parallel procedures for proving foreign official records.

Our role is to deliver the translation and the supporting documentation counsel uses to lay the foundation. Every order includes a signed Certificate of Accuracy. On request we provide a notarized affidavit setting out the translator's qualifications, suitable for FRE 901 use. We do not give legal advice on admissibility; that judgment is for counsel of record.

Legal documents look different depending on whether they originate from a civil-law jurisdiction or a common-law one. Civil-law systems rely on detailed codes and notarial deeds; common-law systems rely on case law and party-drafted contracts. The translator's job is to render each in English without imposing the structure of the other.

Common formats we translate every week include French actes notariés and signification d'huissier, German Urkunden and Handelsregister extracts, Spanish escrituras públicas and sentencias firmes, Italian atti notarili and sentenze, Brazilian escrituras and sentenças, Russian dogovor and sudebnoe reshenie, Chinese contracts and court judgments issued under the People's Court system, Arabic notarized contracts and sharia-court rulings, and Indian deeds executed under the Registration Act with stamp duty endorsements.

Defined terms and party labels are preserved as written in the source. We do not silently translate "the Lessor" into a US-style "Landlord" or convert "the Court of First Instance" into "Trial Court." Where a literal English equivalent does not exist, we translate functionally and add a translator's note. Counsel and the receiving authority then make any further interpretive judgment.

Handwritten clauses and margin notes remain common in older contracts, civil-law deeds, court file annotations, and corporate minute books. Even in modern files, judges, registrars, and notaries frequently add handwritten endorsements, dates, and signatures. We translate all of these under the same certification standards as printed text.

Frequent sources of handwritten legal content in our work include older European notarial deeds and registry endorsements, mid-century South Asian land deeds with handwritten descriptions of survey numbers and boundaries, Latin American court file annotations, calligraphic Arabic notarial endorsements, and corporate minute books from many jurisdictions where the secretary records resolutions by hand. Our translators include specialists in each of these traditions.

For evidentiary use, accuracy on handwritten content matters more than for printed text. A guess at a handwritten amendment can change the meaning of a clause, which is why our translators mark genuinely unreadable handwriting as illegible with an explanatory note rather than reconstructing it. If a key passage is unreadable, the cleaner path is usually a fresh certified copy from the registry or court rather than a translation built on guesswork.

Court files, registry copies, and older contracts often show wear from age, water damage, sun exposure, and normal handling. We translate what is clearly visible and mark genuinely unreadable portions with explanatory notes. The translator never invents missing text or fills in clauses that are not legible in the source. For litigation use this principle is essential, since invented content destroys evidentiary value.

Before ordering, check whether a fresh copy is available from the issuing court or registry. Most jurisdictions can produce a certified clean copy of a judgment, registry entry, or notarial deed. Replacement copies are typically faster and cleaner than translating from a damaged document, particularly for filings where opposing counsel may otherwise demand the unredacted source.

When translation from a damaged document is the only option, upload the clearest possible scan and include all visible portions, including margins, court stamps, signatures, and any apostille. If we cannot confidently produce a usable translation, we contact you before charging and discuss alternatives.

Authentication of foreign legal documents typically follows one of three paths. For documents originating in a Hague Apostille Convention country and intended for use in another Convention country, an apostille issued by the competent authority of the country of origin is sufficient. For documents from non-Convention countries, consular legalization through the destination country's embassy or consulate is the established route. For US federal court use of certain foreign public documents, the FRE 902(3) certification chain provides a path to self-authentication.

The Hague Apostille Convention abolishes the requirement of legalization between member states for public documents, and an apostille issued by the competent authority of the country of origin is the standard mechanism. For non-Convention countries, consular legalization through the destination's embassy or consulate is the established route.

If your document carries an apostille or consular legalization, the text of that authentication is also translated as part of our standard order. Translation does not create authenticity; it makes the authenticated source readable. Decisions on which authentication path applies to a given matter are for counsel of record.

Foreign legal documents often contain defined terms, party labels, and civil-law concepts that have no direct US-English equivalent. The translator's task is to render these accurately without imposing the structure or labels of common-law US practice. Where a literal English equivalent does not exist, we translate functionally and add a translator's note explaining the source-language meaning.

Defined terms are preserved as the source defines them. If a contract defines "the Lessor" or "le Bailleur" as a specific named party, we render it as "the Lessor" throughout, not as "Landlord." Civil-law instruments often use roles such as notario, commissaire aux apports, syndic, and Registrar General that do not collapse into a US-English label without losing meaning. We render these terms literally on first use, with a translator's note where helpful, then carry the rendered term consistently through the document.

Party names follow the same rule. A name written in Arabic, Chinese, Cyrillic, or Devanagari script has no single correct English spelling, and different documents may transliterate the same name differently. We render names exactly as they appear in the source document. If you need a preferred spelling noted (for example, to match a passport or US filing), we add it as a translator's note rather than changing the rendered name in the body of the translation.

One certified legal translation can typically be reused across multiple destinations. The same PDF used as an exhibit in a US federal court matter can be referenced again in a USCIS filing, attached to an arbitration exhibit list, or included in a corporate due-diligence binder. The Certificate of Accuracy is the element that makes the translation acceptable, not the specific destination it accompanies.

Practical exceptions apply for trial use. Counsel offering a translation as evidence at trial often prefers a freshly executed translator's affidavit dated close to the hearing, rather than reusing one signed years earlier. Some arbitral tribunals also prefer recent dates. If a fresh affidavit is needed, we issue one at no additional cost for any order we originally completed, and we keep the file on hand for the standard retention period so reissue is straightforward.

Translations we produce meet the certification standards used by USCIS, UKVI, IRCC, ECFMG, US federal and state courts, and major arbitral tribunals (ICC, LCIA, ICDR, ICSID, UNCITRAL). The Certificate of Accuracy meets the common requirements of translator competency, completeness statement, signature, and date.

Translation-related challenges to legal documents follow predictable patterns. Understanding what each receiving party scrutinizes helps applicants and counsel avoid avoidable delays.

The most frequent causes of legal translation rejection or evidentiary challenge, in approximate order of frequency: paraphrasing or summarizing clauses instead of rendering them word for word; substituting US-English defined terms for source-language defined terms; an incomplete, unsigned, or undated Certificate of Accuracy; missing apostilles, court stamps, or notarial seals visible on the original; reconstructing damaged or illegible portions instead of marking them as illegible; converting amounts, currencies, or dates to US format inside the translation; and party-name inconsistencies across the translation, the original, and other case documents with no explanatory note.

Our translations are structured to avoid all of these. Every clause is rendered word for word. Defined terms and party labels are preserved. The Certificate of Accuracy is typed, dated, signed, and includes the translator's full name and contact information, and a notarized affidavit setting out qualifications is available on request.
